General Terms of Use (for agencies)

The present General Terms of Use govern all legal relationship

BETWEEN :

PROJETVOYAGE SRL, hereinafter referred to as « Projet Voyage » company with a share capital of 25.000€, whose head office is located in Bucharest (ROMANIA), Decebal Bld, 4, 3rd District, registered with the Registry of Commerce of Bucharest under number J40/8772/09.06.2017, having the fiscal identification number: 37723910

AND

All Travel Agency registered on the travel platform, hereinafter referred to as “The agency”

1.Description of the website

1.1.  Definitions

1.1.1. ProjetVoyage is an online travel platform, connecting travelers (visitors/users of the platform) to travel professionals (Travel Agencies).

1.1.2. The Travel Market is a virtual space where the Travel Agencies registered on the Projet Voyage platform, can find travel inquiries relevant to their profile, sent by the travelers (visitors/users of the travel platform).

1.1.3. The Travel Agencies are travel professionals registered on ProjetVoyage travel platform.

1.1.4. The Subscription/Membership is the agreement between Projet Voyage and each Travel Agency registered on the website, under which, as agreed by the Contracting Parties, the Travel Agency can use the services provided by ProjetVoyage. The price of the subscription is the cost of use of the platform.

1.1.5. The Agency Account is that part of www.projetvoyage.com, dedicated to the Travel Agencies registered on the travel platform, where a Travel Agency can edit its profile, consult the travel inquiries sent by the website’s Users and unlock them, add Users, write articles on the Blog, consult the membership’s details, consult the General Terms and Conditions.

1.1.6. The Users/Visitors are travelers – individuals using the website of ProjetVoyage, interested in finding a Travel Agency to plan their next travel or to send a travel inquiry for the planning of their travel.

1.1.7. The Travel Inquiries are offer requests sent by the Users interested in receiving an offer for the planning of their trip.

1.2.  General description of the travel platform

1.2.1.The visitors (Users) of www.projetvoyage.com can either search for Travel Agencies and incoming Travel Agencies in over 150 destinations around the world, or simply send their travel project and receive personalized offers. In order to send a travel inquiry, the visitors (the Users) of www.projetvoyage.com can simply fill in the travel inquiry form available on the website. A Travel Agency with a Premium Membership will have access to the travel inquiries sent by the Users, matching the agency’s profile. In the “Agency Account”, the Travel Agency will be able to learn more on the value of each inquiry.

1.3.  Website’s accessibility

1.3.1.The website is generally available 24h/24, 7/7 for its Users as well as for the Travel Agencies registered on the travel platform. Nevertheless ProjetVoyage will not be held responsible for the website’s discontinuity and its services, in particular for maintenance and updating purposes.

1.4.  Registration and access

1.4.1.All travel agency recognised as travel professional can register on ProjetVoyage travel platform and become a member of the network. At registration, the Travel Agency shall provide the following information : the agency’s name, address, the city and country of the agency, the email, the website, the company’s name, the company’s registration number, the number of the travel license, the languages spoken by the agency, a brief description of the agency in each of the languages spoken by the agency, the destination and the travel types proposed by the agency. The agency guarantees the information’s accuracy, precision and authenticity, as provided in the registration form on the Projet Voyage travel platform.

1.4.2.Projet Voyage reserves the right to refuse the registration of a Travel Agency if the latter does not correspond to the present General Terms of Use (for agencies) or if Projet Voyage believes there are doubts regarding the reputation, the credibility, the accuracy, the authenticity of all information provided in the registration form on Projet Voyage platform.

1.4.3.After having filled in the data and information as required, the registration request of the Travel Agency will be looked into and solved in reasonable time. The mere registration request does not mean the registration on the travel platform is authorized.

1.4.4.Following the subscription and the acceptance of the Travel Agency, a user and a password will be sent to the latter. The information is stricly confidential and non-transferable. This information will be asked for in order for the Travel Agency to have access to the Agency Account on www.projetvoyage.com. The Travel Agency  undertakes exclusively the responsability for the security of its user and password.

1.4.5.The Travel Agency hereby agrees not to use another Travel Agency or User’s account on www.projetvoyage.com, as well as not to disclose the Travel Agency’s user and password to a third party.

1.4.6. The Travel Agency can request the closure of its Agency Account, as well as the removal of the information provided, at any time, by sending an email to contact@projetvoyage.com. The Agency Account will be shut down as soon as possible. Nevertheless, Projet Voyage reserves the right to record all information which could be of use in case of a complaint or dispute. However, the information will not be available online.

3.Payment

3.1.The Premium Memberships are paid subscriptions. The price for a paid subscription is established according to the number of destinations, as well as the travel types proposed on the Projet Voyage travel platform. The fares are expressed in Euros (all taxes included, including the VAT, at the rate in force on the day of the order).

3.2.Following the order of a Premium Membership, the Travel Agency will receive all the information needed for the online payment, which is to be done on the Paypal platform. Following the confirmation of payment, the order will be validated on the travel platform. In the event of refusal of payment, your order will be cancelled.

4.Intellectual property rights of data and other information

4.1.ProjetVoyage S.R.L. is the holder of the concept, of the rights related to the website’s structure, as well as of the texts and he visuals comprised on ProjetVoyage.

4.2.All element provided by each Travel Agency registered on ProjetVoyage (agency’s name, logo, photos, text, articles) is the property of the Travel Agency. ProjetVoyage accepts no responsibility whatsoever with regard to the accuracy of the information provided by the agencies registered on ProjetVoyage on the website and/or in the offers sent by the Travel Agency to the customer.

4.3.ProjetVoyage will not be held responsible for the articles published by the Travel Agencies on the Blog of ProjetVoyage.

4.4.If the Travel Agency believes its intellectual property has been unfairly copied, please contact us by email at contact@projetvoyage.com.

5.Confidentiality

5.1.ProjetVoyage takes the protection of data very seriously. When registering on Projet Voyage travel platform, certain confidential information will be requested to the Travel Agency: the name of  the company, the registration number from the Registry of Trade and Companies, the travel license number, the Travel Agency’s email address. Projet Voyage takes responsibility for ensuring the protection of the confidential information.

6.Projet Voyage Newsletter

6.1.ProjetVoyage intends to keep you regularly informed on the novelties, promotions and special events of ProjetVoyage. Once registered on Projet Voyage travel platform, the Travel Agency will automatically receive the Newsletter on the email address provided in the registration form. At all times, the Travel Agency will be able to unsubscribe from ProjetVoyage Newsletter, by sending an email at contact@projetvoyage.com.

7.Responsibilities

7.1.ProjetVoyage is an intermediary between the Travel Agency, and the Users sending travel inquiries on the travel platform. ProjetVoyage will not be held responsible in the case of fraudulent use of the travel platform or if ProjetVoyage’s activity is unprofitable. Likewise, ProjetVoyage shall not be held responsible for the contract between the Travel Agency and the Users or for contract execution. ProjetVoyage will not act as a mediator between the Travel Agency and the Users and shall not have the authority, responsibility or involvement in regard to the relations established between the Travel Agency and the Users, other than that which is stated in these General Terms of Use. The Travel Agency shall use ProjetVoyage travel platform at its own risk.

7.2.ProjetVoyage declines all responsibility related to the prejudice that might arise following the use of the website, as well as following the inaccuracies stated on the website and on the websites its pages send.

7.3.ProjetVoyage, its directors, officers, employees and representatives are not responsible for the quality of the travel offers sent by the Travel Agencies, for all its order operations and its delivery services.

7.4. The Travel Agencies shall use the personal data of the Users strictly within the limits and conditions stipulated in the present General Terms of Use.

7.5. It is strictly forbidden for the Travel Agencies to publish or reveal to third parties personal data of the Users or use it for other purposes than those stipulated in the present General Terms of Use.

8.The Blog and the Articles

8.1.The Travel Agencies with a Premium Membership can contribute to the ProjetVoyage Blog. Each contributor is responsible for the accuracy and the authenticity of the article. ProjetVoyage reserves its right not to publish an article, if it is believed not to comply with the Blog’s format.

8.2.The articles can be adapted in order for them

9.Third party websites

9.1.When using ProjetVoyage, depending on the Membership, the Travel Agency will be able to provide links to other websites. ProjetVoyage shall not be held responsible for the information provided on the third-party website or their activity.

9.2. The editor of www.projetvoyage.com reserves the right to delete all links to third-party websites, if the editor find it to be unfit to the purpose of ProjetVoyage.

10.Assistance

10.1.All request for assistance will be sent to the team ProjetVoyage by email at contact@projetvoyage.com or by phone at +33 183 81 87 03, Monday to Friday, from 08h30 to 17h00 (GMT+1).

11.Law and Disputes

The present General Terms of Use are subject to the Romanian law. All litigation between ProjetVoyage and the Travel Agencies will be submitted to the jurisdiction of the courts from the geographical area in which ProjetVoyage has its head office.
